TERMS DEFINITIONS
1. All the terms in these Rules are used in the following meanings:
  1. Site Administration - An Contractor and/or persons authorized by him to manage the Site and provide services to Buyers and Sellers;
  2. Contractor - Individual entrepreneur Koloskova Tetiana Viktorivna;
  3. Legislation - current legislation of Ukraine;
  4. Site - Internet-site trends-hunters.com, which is a communication platform for placement of Announcements on goods selling, which is administered by the contractor.
  5. Product - any item offered by the Seller for sale using the Site.
    Other terms in the text of these Rules are used in the meanings defined in the Public contract (offer).
  6. User - Buyer, Private Seller or Professional Seller who uses the services of the Site by accepting this agreement.
  7. Buyer - User of the Site services who will purchase the Goods. The buyer can be any able-bodied individual who has reached 18 years of age, a natural person-entrepreneur, a legal entity that has accepted the Offer. A person under the age of 18 must provide the Administration of the Site with the consent of the parents to perform the relevant transactions related to the use of the Site services.
GENERAL PROVISIONS
1. The rules define the procedure for purchasing Goods using the online service Trends Hunters posted on the Website of the Contractor on the Internet at the link trends-hunters.com, a set of services for verification of goods placed in the Ads for authenticity and originality, as well as the procedure for returning goods.
2. The Contractor is not an Owner of the Product placed in announcements for products sale. Rights and obligations of the Contractor are determined in these Rules and Public Agreement (offer).
3. the Seller's right to place Ads on the Site and the Right of the Buyer to purchase goods on the Site arises after their registration in accordance with the terms of the Public Agreement (offer).
4. Payment is made exclusively in national currency (UAH)
SELLER'S STATUS
1. The Seller on the platform may have one of two statuses - professional and private.
2. Private seller - is a Site User who has placed an announcement on the Site with a purpose to sell the Product. Any able-bodied person who has reached the age of 18 and accepted the Offer, can be a seller. A person under the age of 18 must give the Site Administration the consent of the parents to commit relevant transactions related to the use of the Site's services.
3. Professional seller – is a User of the Site services, who placed an ad on the Site for the purpose of selling the Goods. A professional seller may be a legal entity or an individual entrepreneur who has adapted the Offer and is enabled to commit transactions related to the use of the Site's services.
4. Private sellers have the right to post on the Site and sell personal belongings. For such belongings, the seller’s requirements provided by the consumer protection legislation are applied with the consent of the seller.
5. The enumeration of the Goods posted on the Site and their price is determined by the Seller independently considering the provisions of the Public Agreement (offer)
PRODUCTS
1. While placing the Announcements on the Site, the Seller should provide the following information:
  - a brand of the product;
  - product name and price;
  - information of the product (including color, size, condition, defects/ imperfections);
  - additional information about the Product according to the functional requirements of the Site;
  - photos of the Product;
2. The Seller is responsible for the content of the Announcements;
3. Product information provided in the Announcement, is kept by the Seller up to date.
4. Once the product had been used, the Private Seller ought to make a corresponding note about it and indicate existing defects/imperfections.
5. The private seller has the right to provide the following additional information regarding the Goods:
  - vintage – rare and iconic things with a history, ages 15 and older;
  - with a tag – worn things with labels, without traces of use and defects;
  - excellent condition – things in excellent condition, were used several times;
  - good condition – things that were used neatly and may contain minor defects.
6. The buyer must carefully read the information about the Product. In case of any questions, the Buyer has the right to contact the Seller by posting a comment with the relevant question under the Announcement of the sale of the product in which the Buyer is interested.
7. The minimum price of one product offered for sale on the Site can not be less than UAH 1,475 (one thousand four hundred and seventy-five) hryvnias.
PURCHASE OF PRODUCTS
1. If the Seller agrees to purchase the Goods on the terms offered in the Announcement, the Buyer clicks on the button "Add to cart".
2. When making an order, the Buyer confirms that he has read the information about the goods and received it in the amount sufficient to make the purchase.
3. The sum paid by the Buyer of the Product is blocked on the Buyer's bank card after adding the Product to the basket, filling in the payment details and pressing the "Pay" button.
4. The seller has the right not to confirm the sale of the Product. In this case, the transaction is considered to be canceled, and the blocked funds on the Buyer's bank card will be unlocked.
5. The Seller within 2 (two) working days since the moment of the Buyer’s order, is obliged to sell the Product to the address provided by the Contractor in the Seller’s account to examine and detect authenticity and originality of the Product. In case of successful examination, the Contractor allows the payment system through which the payment is made, to transfer the blocked funds from the Buyer's card account to the Seller.
6. In case the Seller does not send the product to the address provided by the Contractor within 2 (two) working days from the date of the Buyer’s order, such agreement is considered to be canceled, and the funds blocked on the Buyer's account will be unlocked.
7. The Buyer's obligation to pay for the Product is considered fulfilled from the moment of crediting 100% of the funds to the Seller's account.
8. The cost of the Goods may be reduced in accordance with the provisions specified in paragraph 5.10. and provisions of the Public Agreement (offer).
9. Once the Expertise of the Contractor detects that the product does not correspond to the description stated in the announcement, the blocked money on the Buyer's bank card will be unlocked. At the same time, the Contractor may contact the Seller and agree on the change of the price of such product. If the Seller agrees to the price change, he/she ought to change it in the announcement. The Contractor informs the Buyer and offers to buy the product at a new reduced price. If the Buyer agrees to the proposed price of the product, the Buyer reorders the product.
10. The delivery of the Product is carried out only when 100 % sum is received.
11. The Buyer is solely responsible for providing incorrect (irrelevant, inaccurate) data that made delivery of the Product impossible.
12. The Contractor sends the verified product to the Buyer. Delivery of the product is carried out at the expense of the Buyer.
13. The Contractor delivers the Goods to the Buyer in the following ways:
  - Shipment of the product on the territory of Ukraine is carried out by the company "Nova Poshta" or courier (only in Kiev). The delivery of the product on the territory of Ukraine takes more than 2 days. Delivery services are paid by the Buyer while receiving the Product. The cost of delivery of the product is determined in accordance with the tariffs of the company "Nova Poshta". The cost of delivery services carried out by courier in Kiev is 100 UAH.
  - International shipments are carried out by international postal operators. The delivery time of international shipments will take more than 7 days. The Contractor shall not be liable for the terms of delivery of international shipments, as well as for possible delays of goods by customs authorities. Customs duties are not included in the shipping cost and are paid by the Buyer in each case separately.
  - The price of goods that are not realized within 45 calendar days from the moment of creation of the announcement by the seller may be changed by 20% by agreement with the Seller. The site automatically sends the Seller an offer to change the price of the product with a Pop-Up message in your personal account on the site. The Seller has the right to agree or refuse the offered price within thirty calendar days from the date of sending this message. Every 45 calendar days from the moment of creation of the announcement by the seller, the Contractor has the right to initiate a 20% price reduction.
PRODUCT EXAMINATION
1. In accordance with paragraph 5.4.of These Rules, The Product intended to be purchased by the Buyer by applying the option "Add to cart" must be examined in the Trends Hunters office to detect the authenticity and originality of the Product.
2. If the product is proved to be not original and authentic, the Contractor may send this product to the Seller with an invoice payment with a demand to pay in hryvnia that equals to 50 (fifty) USD at the official exchange rate of the NBU on the examination completion date as compensation of its conduct.
3. If the products of Hermes are proved to be not original and authentic, the Contractor sends this product back to the Seller with an invoice payment with a demand to pay in hryvnia that equals to 135 (one hundred thirty five) USD at the official exchange rate of the NBU on the examination completion date as compensation of its conduct.
4. In cases stipulated by p. 6.2. and 6.3. of Rules The Seller's Account on the Site is blocked by the Contractor, while the return of the Product is carried out at the expense of the Seller.
PRODUCT RECEIVING
1. - by the delivery man within Kyiv;
  - in one of “Nova Poshta” departments;
  - by the address delivery of “Nova Poshta”
2. The delivery man is not obliged to check the recipient's authority to receive the Product if the recipient is at the delivery address;
3. Once the Product is not accepted on a certain date (including the services of delivery, transport company for responsible storage of unaccepted Product, services of full Product delivery), the Buyer is obliged to reimburse the Contractor for documented expenses.
4. The Buyer is obliged to ensure the proper acceptance of the Product, including the presence and integrity of the packaging. In case of damage to the packaging and other defects of the Product, the Buyer is obliged to immediately notify the Contractor. Otherwise, the following claims regarding incompleteness and damage to the Product will not be accepted.
5. The Buyer is obliged to accept the Product by its name, quantity and range at the time of its acceptance.
6. Upon acceptance of the Product, the Buyer or the Recipient confirms with his signature that he has no claims to the appearance, name, quantity and completeness of the Product, as well as is familiar with the rules of return of the Product.
7. Ownership and the risk of accidental loss or damage to the product is passed to the Buyer from the moment of transfer of the Product to him or the recipient.
PRODUCT RETURN
1. The product bought by the Announcement of Private Sellers is a subject to return with a consent of the latter. The product provided for in Annex No. 3 to the Resolution of the Cabinet of Ministers of Ukraine of March 19, 1994 No. 172 shall also not be subject to return.
2. The Buyer has the right to return the Product of proper quality within fourteen days, not counting the day of purchase.
3. A product of proper quality is a product that fully complies with the description of the Professional Seller.
4. Only a product purchased from a Professional Seller that have not been used are subject to return, provided that:
  - preservation of its product appearance and consumer characteristics;
  - no stains and spots;
  - preservation of seals, labels, tags, protective films;
  - preservation of factory markings;
  - integrity of all parts of individual (factory) packaging.
5. To return the Product, the Buyer must fill in and send to the Contractor together with the Product a form that can be downloaded at the link: https://trends-hunters.com/delivery/.
6. The following categories are not a subject to return:
  - products for newborns;
  - underwear, bodysuits, corsets, bathing suits;
  - nightgowns, pajamas, bathrobes, home suits;
  - hosiery;
  - gloves, mittens;
  - Jewelry.
7. Return of the products specified in this paragraph of the Rules is possible only in case of detection of defects or in case of non-compliance with the order.
8. The product may be returned under the conditions specified in this section of the Rules by sending them by courier service, agreed in writing with the Administration of the site. Return of the product is made at the expense of the Buyer. The cost (rates) of sending the returned goods are determined by the relevant courier service. When making a return of the goods, the Buyer must determine the estimated value of the goods equal to the cost of its purchase.
9. The Contractor will not be able to accept the goods if it is returned using cash on delivery. In this case, the shipment will be returned to the sender and the return procedure will be considered as not having taken place at the initiative of the Buyer. The Buyer loses the right to re-return the goods to the Contractor in the case of its sending using a cash on delivery and has no right to make claims to the Contractor in the event of such actions.
10. Refund for the product is made to the buyer's bank card automatically, provided that the returned product meets the conditions of return provided for in this section. The refund period is 7 working days from the moment when the returned product is received by the Contractor, as well as the provision of scanned copies of the Buyer's passport (1-4 pages) and a handwritten application in which all fields are filled in correctly. In this case, the User undertakes to provide the Contractor with all necessary documents for the return of the product. In case of failure to provide all documents for the return of the product in a timely manner, the refund period is automatically extended in proportion to the number of days of such delay
THE OTHER
1. The Rules come into force from the moment of their placement on the Sitetrends-hunters.com and are valid until the moment of their change or revocation by the Contractor.
2. Changes to the Rules may be made by the Contractor at his own discretion at any time. In case of changes in the Rules, they come into force from the moment of their placement on the Site trends-hunters.com. Changes to the Rules may be implemented by the Contractor, indicating the time of their entry into force.
3. All other conditions of sale of the product that are not regulated by the provisions of these Rules of sale of goods are governed by the provisions of the Public Agreement (offer).
4. In case of disagreement of the Buyer with any provision of the Rules of sale of goods, the Buyer is not entitled to use the online service Trends Hunters.
5. The buyer undertakes to familiarize himself with the current version of the Rules of sale of the product and bears the risk of not reading them.
6. All other conditions of sale of goods that are not regulated by the provisions of these Rules of sale of goods are governed by the provisions of the Public Agreement (offer).
